Employment Law and Civil Rights Litigation

Employment Law Matters   

The attorneys of ThorsenAllen are devoted to effective and compassionate representation of individuals who have encountered unfairness or wrongdoing in the workplace. The firm represents handles discrimination claims based upon sex, race, religion, national origin and pregnancy under Title VII of the Civil Rights Act of 1964, including sexual harassment matters. An employee may experience discrimination with an employer’s practices or procedures for recruitment, hiring, firing, advancement, or pay. Some employees are faced with harassment based upon a legally protected class by a supervisor or coworker that may result in a hostile work environment. Our office will diligently advocate for those who have experienced discriminatory and unlawful treatment in the workplace.  

        The firm also handles employment matters arising from the Fair Labor Standards Act (FLSA) and Family and Medical Leave Act (FMLA) and assists clients with concerns about their entitlement to minimum wages, overtime, and equal pay as well as the availability of leave from work for certain medical or family reasons. 
​ In addition, ThorsenAllen attorneys provide representation for violations of the Age Discrimination in Employment Act (ADEA) and Americans with Disabilities Act (ADA) and will work to restore fairness to those violated by noncompliant workplaces. Our attorneys fight for courageous whistleblowers who have encountered unlawful retaliation for exposing misconduct or illegal activities by their employers.

Other Civil Rights Cases

      The lawyers of ThorsenAllen have unique and diverse experience in the complex field of civil rights law. Matters handled by the firm involved Constitutional principles such as the right to free speech, due process, and equal treatment under the law. Other cases arises under the Civil Rights Act of 1964, including § 1983 claims for discrimination, and legal actions for violations of constitutionally protected rights involving claims of excessive police force, unreasonable seizure, false arrest, and malicious prosecution. The firm has also handled cases on behalf of incarcerated individuals who have been suffered injuries as a result of constitutional violations and gross negligence.

Personal Injury 
 
      ThorsenAllen provides representation to individuals who have suffered personal injuries in a wide range of cases. The firm handles cases involving severe injuries or death resulting from motor vehicle incidents, slip and fall or premises liability case, injuries from animals such as dog bites, and medical malpractice. The firm also handles applications and appeals for Social Security benefits.
Most personal injury cases involve the negligence or unreasonably unsafe actions or omissions of an employer, manufacturer, doctor or other person or entity that owes a duty of ordinary care, but the firm is also experienced in handling injuries caused by the intentional acts of others. 
​      Jim Thorsen has successfully handled a number of significant cases involving defamation and malicious prosecution and, as a result, the firm has developed extensive experience in this area.

Family and Education Law

     The lawyers of ThorsenAllen counsel and represent individuals in domestic relations cases involving divorce proceedings and the related custody and support issues. 
     The firm also works to help families and students resolve issues relating to school faculty, staff, and students, including school discipline, special education, and discrimination based on race, color, national original, sex, or disability in violation of the Individuals with Disabilities Education Act (IDEA), the Rehabilitation Act (Section 504), the Americans with Disabilities Act (ADA), and the Equal Educational Opportunities Act (EEOA).  
​ In special education law matters, the firm’s focus is always on the individualized needs of the student and taking the necessary steps to ensure that the school meets those needs.

Complex Civil Litigation

     Outside of its emphasis in the laws involving employment and civil rights, family and education, and personal injury and medical malpractice, ThorsenAllen lawyers are experienced in a wide variety of complex civil litigation. The matters handled by members of the firm include construction cases, and commercial disputes.  
     ThorsenAllen maintains an active land use and zoning practice including litigation involving zoning ordinances and land use permits. This area of law may involve proceedings before boards of zoning appeals or local governing bodies, circuit court trials, and appeals to the Virginia Supreme Court for judicial review of zoning and land use decisions.
​ The firm’s lawyers have handled trials before judges and juries in state and federal courts across the state and they have represented individuals and businesses in administrative hearing processes. When necessary, the firm handles appeals, including appeals in the Virginia Supreme Court and the United States 4th Circuit Court Appeals.
